As such, human resource managers ought to be well versed with employment and workplace laws; but need to use their discretion to act ethically when dealing with people. This is because what is ethical does not always mean it is legal (Deckop, 2006). The Ideal Legal and Ethical Hiring Practices There are federal laws that govern hiring of staff by organizations. For Greenhill Memorial Hospital, the conflict between Brad and his supervisor can be resolved by a careful examination of the ideal legal and ethical practices of hiring. The first area of interest as far as legal issues are concerned is that it is illegal to discriminate anyone during the hiring process (Querin, 2009) As such, should Brad’s claims that he is being discriminated against on the basis of his gender and sexual orientation be confirmed as true, then his supervisor is liable for criminal charges. This is in accordance with the provisions of Title VII of the Civil Rights Act which prohibits discrimination based on color, race, sex, religion, and nationality (Guerin, 2009). It is therefore critical that Brad is given a fair chance during the selection process. Another legal requirement when hiring staff is that there ought to be a blend of different people as opposed to a homogenous workforce (Guerin, 2009). The law, on this basis, requires that hiring companies make advertisements for the vacancies they have and carry out a fair selection process based not only on qualifications but also on the need for maintaining a heterogeneous workforce. The organization is then expected to maintain a record of all the applicants for a given position, the number of those who qualified and those who failed, as well as the reasons for their failure (Guerin, 2009). This helps to ensure that the process is fair and legal. There has to be no focus on specific attributes of the person in making such advertisements except that the need for the applicant to be qualified. Even more unethical is that she has filled it up with her own friend. It is also unethical for her to fail to let Brad, who has worked in the job for twelve years and is obviously better qualified, to have the job. Even more unethical is the fact that Brad is really in need of a morning shift job as he is going to have to give up his evening shift job because of his other commitments. Obviously, any ethical supervisor would view his case as a deserving one (Deckop, 2006). However, legal issues ought to always be given priority over ethical ones (Deckop, 2006). For instance, there has to be proof that no-one else is qualified for the job before Brad can be considered on ethical grounds. The law usually does not use ethics to determine the due process. Ethics remains the preserve of the individual people dealing with the process and cannot be cited in legal proceedings (Deckop, 2006). Brad also ought to understand that he is not supposed to make allegations based on rumors only. He also has to understand that he has the legal right to complain to her boss about work-related problems without fear of being dismissed or punished. Neither can he be terminated on such a basis. Retaliation is an offence that is usually treated as an act of discrimination because retaliating is essentially acting against someone based on personal reasons as opposed to legitimate issues affecting the organization. Acts of retaliation usually overrule any other issues that the employer might have done to justify any disciplinary measures by the employer (Deckop, 2006). For instance, even if what Brad heard was baseless and only rumors, any retaliation by his supervisor upon his reporting or complaining will overrule any of his faults. Finally, Brad ought to rest assured that the law of employment protects everyone – the employer as well as the employee (Guerin, 2009). In this respect, he ought to understand that a unilateral decision by his supervisor cannot be effected without the involvement of the human resource manager and other relevant management staff.

Beauty is Only Skin Deep, Ugly Goes to the Bone I am not easily recognized, or rather, I am easily ignored. My style of dress is a cardigan and jeans, or when it's warmer, a T-shirt and jeans. Occasionally I'll wear khakis. I am a very unnoticeable 5'3'' and have eaten just enough chocolate to have a round face and figure. With all of this in mind, when I tapped the shoulder of the up-to-the-minute girl lip-locked with her boyfriend-of-the-day, I was not greeted with a warm smile. I frequently disturbed this couple, since my locker was in Make-Outville. It is interesting, however, that I am the first (technically third, I suppose) to find out what new couple has gotten together. As I was pondering why our lockers are neon orange when our school colors are red and black, I exaggerated the act of dropping each book into the metal box to enjoy the humor of the "you-only-wish-you-could-have-what-I-have" look from the heavily outlined eyes behind me. The irony is - I don't want that. No, I am not a nerd in denial; that is just not what I want. Exchanging saliva with a different guy every week and making sure I look just like Jennifer Love Hewitt or any other three-name girl is not my top priority. Sorry to disappoint you Miss "I can't believe I had to buy a size 3," but you're a little conceited to think everyone wants to be just like you. I'll tell you what I want: I want to go to college. I want to get good grades. I want everyone to be nice. I want a cure for Alzheimer's so my grandmother and my family can have Grandfather back. I want to get to my locker without being scrutinized. Oh my goodness, what an outcast I am. What a nerd! Whatever is the matter with me? I like boys. Simply because I choose to search for someone who makes me happy (and that just happens to take a while) does not automatically prove that I live an "alternate lifestyle." Sorry to disappoint you; I apologize for taking away today's lunchtime conversation. I will tell you what I want in a boy. I want him to open doors for me. Old-fashioned or not, I appreciate that greatly. I want him to be my best friend. I want to be able to go to him with anything and for him to care about what I say.

Rhetorical Analysis: The Crisis, No. 1 by Thomas Paine Political writer, Thomas Paine, in his persuasive writing, The Crisis No. 1, expresses feelings towards Britain's control over the colonies. Paine's purpose is to unite the colonists in an effort to retaliate against Great Britain. He uses an objective tone in order to unite and rally the common person in his nation. Paine opens his persuasion to the nation by warning that getting their freedom from Britain will not be easy. By using the simile, â€Å"Tyranny, like hell†¦ , he implies that Britain's control over them will not be easy to overcome. As he says in the beginning of the paragraph, â€Å"The summer soldier and the sunshine patriot will†¦ shrink from the service†¦ but he that stands it now, deserves the love and thanks of man and women. â€Å", this states that anyone who will not fight for their country does not deserve their country, he uses pathos when declaring this statement. In the latter section of this paragraph, Paine uses the metaphor, â€Å"†¦ f being bound in that manner is not slavery†, to show that the way that the Britain is controlling them, makes them feel like slaves. Paine later uses ethos when he states, â€Å"However, the fault, if it were one, was all our own; we have none to blame but ourselves. But no great deal is lost yet. † He says this to show the nation that they had messed up in the beginning, but if they were to come together they could right the wrongs that were done. In the following paragraph Paine uses pathos when he talks about God not giving up on his people.That God will provide for them and not give them â€Å"up to the care of devils†. he also states that God will be on their side, â€Å"I cannot see on what grounds the King of Britain can look up to heaven for help against us: a common murderer†. Paine shifts to talk about panic, how panic can be used to produce good and bad. He uses a simile in paragraph th ree, â€Å"Britain has trembled like and ague†, he uses this to show that even the royal British army can be terrified, later in the paragraph he states, â€Å"the whole English army†¦ was driven back like men petrified with fear†, to emphasize his point more.Paine opens the closing paragraph by uniting the people with ethos, â€Å"The far and near, the home counties and the back, the rich and the poor will suffer or rejoice alike. † In saying that Paine implies, no matter what happens they all will stay together, whether it be death or freedom. He also uses ethos by stating â€Å"Not all the treasures in the world†¦ could have induced me to support and offensive war, I think it murder. â€Å", by saying this Paine shows that war was the last option he would have much rather came to a peaceful solution, but given the circumstances, there was no choice.Paine closes up the paragraph by using an asyndeton, â€Å"Let them call me a rebel and welcomeâ₠¬ ¦ but I should suffer the misery of devils were I to make a whore of my soul by swearing allegiance to one whose character is that of a sottish, stupid, stubborn, worthless, brutish man. † His use of the asyndeton to show that the King is much more than that he listed. In The Crisis No. 1, Thomas Paine creates an objective tone to unite and rally the nation by showing what kind of man the King of Britain is. Paine achieved his goal by using a variety of rhetorical devices. He connected to the nation through the use of his devices.
